1. PARTIES

1.1. This Agreement is entered into under the following terms and conditions between Neptün Turizm Ticaret A.Ş., having its registered address at Sığacık Mah. Akkum Cad. No. 175, Seferihisar/İzmir (hereinafter referred to as the “RESORT”), and the person who provides and confirms their personal information by telephone (hereinafter referred to as the “CUSTOMER”).

1.2. The Resort and the Customer shall each be referred to individually as a “Party” and collectively as the “Parties.”

2. SUBJECT MATTER AND TERM OF THE AGREEMENT

2.1. This Agreement has been prepared in accordance with Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. The Parties acknowledge and declare that they are aware of and understand their obligations and responsibilities arising under Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

2.2. The purpose of this Agreement is to set out the general terms and conditions governing the additional cancellation and amendment rights granted to the Customer in addition to the provisions of the accommodation sales agreement concluded between the RESORT and the CUSTOMER, as well as the respective obligations of the Parties in this regard.

2.3. Within the scope of this Agreement, the Resort and the Customer agree and undertake to provide the services set out below (each individually referred to as a “Service” and collectively as the “Services”) in accordance with the terms and conditions herein.

2.4. The Customer acknowledges and declares that they have been duly informed of the accommodation rules, reservation terms and applicable rates established by the Resort and undertakes to comply with them.

2.5. This Agreement shall enter into force on the date on which the Service is purchased and shall remain in effect until 72 hours prior to the commencement of the Service period. Upon expiry of this period, the Agreement shall automatically terminate without the need for any further notice. In the event of a dispute, the Agreement shall remain in force until the dispute has been finally resolved.

3. RESERVATION AMENDMENT, CANCELLATION AND REFUND TERMS

3.1. The Customer who purchases this protection package, which constitutes an annex to the Accommodation Sales Agreement concluded between the Customer and the Resort, shall be entitled to request cancellation, a refund or an amendment without providing any reason, provided that the relevant request is notified to the Resort no later than 72 hours prior to the commencement date of the Service.

3.2. The Customer may submit a cancellation or amendment request to the Resort either in writing or verbally. Reservation amendments may be made following communication with the Resort via www.clubresortatlantis.com or by telephone, using the reservation number provided to the Customer at the time of booking and the Customer's personal information.

3.3. Where the Customer submits a cancellation and refund request in accordance with this Agreement, the Resort shall deduct only the protection package fee of TRY 1,000 (one thousand Turkish liras). Following the deduction of all transaction fees, commissions and other charges withheld by the bank, the remaining amount paid by the Customer shall be refunded within 30 (thirty) business days, using the same payment method and under the same conditions as the original payment.

3.4. The Customer shall notify the Resort of any request to amend their reservation no later than 72 hours prior to the commencement date of the Service. The Customer hereby acknowledges, accepts and undertakes in advance to pay in full any difference in price arising from amendments made at their request. If the applicable price difference is not paid within 48 (forty-eight) hours following the completion of the amendment, the amendment request giving rise to such price difference shall be deemed invalid. The rates applicable on the date on which the Customer notifies the Resort of the relevant request shall apply to such amendments.

4. DISPUTE RESOLUTION

4.1. In the event that this Agreement terminates for any reason, any rights and obligations accrued up to the date of termination, as well as any rights and obligations expressly or implicitly intended to take effect or remain in force after termination, shall remain unaffected. Subject to the foregoing, all other rights and obligations of the Parties arising from this Agreement shall automatically terminate.

4.2. Any waiver of rights granted to the Parties under this Agreement shall be valid only if made in writing. The failure of either Party to require the other Party to fulfil any obligation under this Agreement shall not constitute a complete waiver of the right to require such fulfilment, nor shall it prevent the relevant obligation from being enforced at a later date or render any provision of this Agreement invalid. Where a Party fails to exercise a right on a one-off basis or refrains from exercising such right in respect of a failure to perform an obligation under this Agreement, this shall not be construed as acceptance of a breach of the Agreement or as a waiver of the relevant obligation.

4.3. In the event of any legal dispute arising between the Customer and the Resort, the Customer shall retain the right to apply to the Consumer Arbitration Committees and/or Consumer Courts. Prior to applying to such authorities, the Customer's submission of their claims to the Resort in writing shall be regarded as an indication of good faith.

5. NOTICES

5.1. All notices relating to this Agreement shall be sent to the addresses specified herein. Unless a change of address is notified to the other Party in writing within one week, notices sent to the addresses stated in this Agreement shall be deemed valid.

6. MISCELLANEOUS PROVISIONS

6.1. If any provision of this Agreement becomes invalid, contrary to applicable legislation or unenforceable for any reason, it shall be interpreted and applied, to the extent possible, in a manner that most closely reflects how it would have been interpreted and applied had such invalidity, non-compliance or unenforceability not occurred. The invalidity, unenforceability or illegality of any provision shall not affect the validity, legality or enforceability of the remaining provisions.

6.2. The Customer hereby acknowledges, accepts and undertakes in advance that, in any dispute arising from the performance of this Agreement, the records maintained by the Resort, including microfilm, microfiche and computer records, as well as fax records, written documents and printouts, shall constitute valid, binding, conclusive and exclusive evidence pursuant to the relevant provisions of the Turkish Code of Civil Procedure (HMK), and that this provision constitutes a written evidentiary agreement.

6.3. This Agreement constitutes an annex to and an integral and inseparable part of the Accommodation Sales Agreement.
